White Clay Digital
Terms of Use
Last updated: April 22, 2026
These Terms of Use govern your access to and use of the White Clay Digital website, forms, communications, consultations, and related B2B SaaS and digital automation services for local businesses, including missed-call response workflows that can send automated SMS follow-up messages. By using our website or services, you agree to these Terms.
About White Clay Digital
White Clay Digital is an informal business name used to provide B2B SaaS, digital services, and automation support to local businesses. It is not currently a separate legal entity such as an LLC or corporation. In these Terms, "White Clay Digital," "we," "us," and "our" mean the person or team operating this website and services under the White Clay Digital name.
Use Of Our Website
You may use our website and publicly available materials for lawful business purposes only. You agree not to misuse the site, interfere with its operation, attempt unauthorized access, submit harmful code, scrape the site at unreasonable volume, or use the site in a way that violates applicable law or another person's rights.
Services And Engagements
White Clay Digital offers digital strategy, local business response analysis, B2B SaaS, software automation, website, marketing, and related consulting services. Our services may help local businesses detect missed calls, send automated SMS replies, collect lead details, route conversations, connect to calendars or CRMs, and report on customer response activity. Any paid work, deliverables, timelines, fees, ownership terms, or service-specific obligations may be governed by a separate written proposal, statement of work, invoice, order form, or agreement. If a separate agreement conflicts with these Terms, the separate agreement controls for that engagement.
Client Responsibilities
If you use White Clay Digital services for your business, you are responsible for your business operations, customer relationships, offers, appointments, services, staff response, and use of the leads or messages generated by the service. You are also responsible for providing accurate business information, keeping account credentials secure, reviewing automation settings and message content, and making sure your team monitors and responds to customer conversations when human follow-up is needed.
SMS And Communications Compliance
Some services may send SMS, email, calls, or other communications on your behalf, such as an automated text to a person who called your business and did not reach someone. You are responsible for using those services in compliance with laws, carrier rules, platform requirements, industry guidelines, and customer permissions that apply to your business and message program.
You agree not to use White Clay Digital services to send spam, deceptive messages, unlawful marketing, harassment, or messages to people who have not provided any required consent or who have opted out. You must honor unsubscribe, "STOP," do-not-contact, and similar requests. We may suspend or limit messaging workflows if we believe they create legal, deliverability, security, platform, or reputational risk.
Information You Submit
You are responsible for the accuracy and legality of information you submit through our website, forms, calls, emails, or other channels. You represent that you have the right to provide that information and that it does not violate any confidentiality obligation, privacy obligation, intellectual property right, messaging rule, platform policy, or law. This includes business customer, lead, caller, and CRM data that you provide or connect to our services.
Automation Limits
Automation is designed to support your customer response workflow, not replace your responsibility to operate your business. Automated missed-call replies, lead capture messages, routing rules, AI-assisted content, reminders, and similar tools may be delayed, filtered, blocked, misunderstood, or unavailable. You should review workflows, test message content, monitor conversations, and provide timely human follow-up where appropriate. The services should not be used for emergencies, urgent safety matters, or regulated communications that require professional review unless a separate written agreement says otherwise.
No Guaranteed Results
We may provide observations, estimates, recommendations, benchmarks, software, or marketing and operational guidance. Business outcomes depend on many factors outside our control, including market conditions, customer behavior, implementation quality, team response, budgets, phone carriers, message deliverability, and third-party platforms. We do not guarantee revenue, recovered customers, leads, rankings, bookings, conversions, response rates, delivery rates, or other business results unless expressly stated in a separate written agreement.
Intellectual Property
The White Clay Digital name, logo, website, text, graphics, designs, software, workflows, reports, and other materials are owned by White Clay Digital or its licensors and are protected by intellectual property laws. Except as permitted by these Terms or a separate written agreement, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from our materials.
Third-Party Services
Our website and services may reference, link to, embed, or integrate with third-party websites, forms, analytics tools, software, hosting providers, telephony providers, SMS carriers, CRMs, calendars, communications platforms, payment processors, or other services. We are not responsible for third-party content, availability, security, terms, privacy practices, fees, message filtering, carrier blocking, delivery failures, outages, or performance.
Privacy
Our collection and use of information is described in our Privacy Policy. By using our website or services, you acknowledge that we may process business, account, caller, lead, message, and automation data as described there and in any applicable service agreement.
